1.Document Overview
This User Privacy Policy covers the information we collect about Cinema Intelligence product or services users. This document also explains your choices about how we use information about you. Your choices include how you can object to certain uses of personal information and how you can access and update certain information about you. If you do not agree with this policy, you can opt out from using Cinema Intelligence and our professional services.

When providing access to our product based on a signed agreement, your organization controls the information processed by Cinema Intelligence.

1.1.Version tracking
We will publicly share any privacy policy updates and, if the changes are significant, we will provide a more prominent notice by sending you an email notification. We encourage you to review our privacy policy whenever you use Cinema Intelligence to stay informed about our information practices and the ways you can help protect your personal data.

2.Product Description
Cinema Intelligence is a business intelligence platform designed to help cinemas better utilize data to increase business productivity and profitability. The software is primarily intended to help exhibitors book and schedule film across multiple cinema locations. Cinemas utilize our advanced forecasting algorithm to predict the expected admissions, box office revenue and net profit per film, per cinema. The applications of data intelligence within the current version include access to insights through dynamic dashboards, predictive analytics, and film schedule optimization.

3. Information collection and usage
3.1.Collected information
We collect personal information when you provide it to us, when you use our professional services under a signed agreement, and when other sources provide it to us, as further described below.

Information you provide to us
We collect information about you when you input it in Cinema Intelligence or otherwise provide it directly to us.

Account and User Information: We collect information about you when your Client Account and User Account are set-up and when you modify your User details, set preferences, sign-up for a webinar or set your profile in our Knowledge Base. For example, you provide your contact information and have the option of adding a profile photo, job title, phone number and other details. We keep track of your preferences when you select settings within Cinema Intelligence.

Content you provide through our products: We collect and store content that you add, send, receive and share. This content includes any information about you that you may choose to include. Examples of content we collect and store include:

-Set-up information from the Account set-up questionnaire
-Change requests and ticket information
-Pages you access in Cinema Intelligence
-Messages you exchange with our Support team
-Feedback you provide to us, when you respond to in-app messages or product notifications.
-Content also includes the files and links you upload to Cinema Intelligence.

Information you provide through our support channels: Cinema Intelligence services also include our customer support, where you may choose to submit information regarding a problem you are experiencing or a product change request. Whether you designate yourself as the contact, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.

Information we collect automatically when you use Cinema Intelligence

We collect information about your usage of Cinema Intelligence, including making certain actions within any module.

Your use of Cinema Intelligence: We keep track of certain information about your usage when you open pages and interact with any of our modules. This information includes:

-Features you use
-Links you click on
-Date of usage
-Country / Region / City where you accessed the product
-Type, size and filenames of attachments you upload
-How you interact with other Cinema Intelligence users in your organization.

Device and Connection Information: We collect information through your device about your operating system, browser type, version and language.

Information we receive from other sources

We receive information about you from other users, from third-party services, from our related companies, and from our business partners.

Other users of Cinema Intelligence: Other users of our Product may provide information about you when they submit content through Cinema Intelligence. For example, you may be mentioned in an issue opened by someone else. We also receive your email address from other Product users when they provide it in order to invite you to Cinema Intelligence. Similarly, an administrator may provide your contact information when they designate you as technical contact on your company’s account.

Vista Group Companies: We might receive information about you, in accordance with their terms and policies.

Cinema Intelligence Partners: We receive information from these partners, such as billing information, billing and technical contact information, company name, what Cinema Intelligence products you may be interested in, evaluation information you have provided, what events you have attended, and what country you are in.

3.2. Information usage
How we use the information we collect depends in part on which Product you use, how you use it, and any preferences you have communicated to us. Below are the specific purposes for which we use the information we collect about you.

To provide access to Cinema Intelligence and personalize your experience: We use information about you to provide access to Cinema Intelligence products, including to process transactions with you, authenticate you when you log in, provide customer support, and operate and maintain Cinema Intelligence. For example, we use the name and picture you provide in your account to identify you to other Cinema Intelligence users in the same Account. We may use your email domain to infer your affiliation with a particular organization to personalize the content and experience you receive on our websites. We combine information about you and your activities to provide an integrated experience, such as to allow you to find relevant product information as you travel across modules or websites.

For research and development: We are always looking for ways to make our Product smarter, faster, secure, integrated, and useful to you. We use information about how people use our Product and feedback provided directly to us to troubleshoot and to identify trends, usage, and areas for enhancement of Cinema Intelligence. In some cases, we apply these learnings to improve and develop new features or to better integrate Cinema Intelligence with your ticketing system. We also test and analyze certain new features with some users before rolling the feature out to all users.

To communicate with you about Cinema Intelligence: We use your contact information to send transactional communications via email and within Cinema Intelligence, including responding to your comments, questions and requests, providing customer support, and sending you technical notices, updates, and administrative messages. We also provide tailored communications based on your activity and interactions with us. For example, certain actions you take in Cinema Intelligence may automatically trigger an in-app message about the latest developments around the accessed feature. We also send you communications as you on-board to help you become more proficient in using the product. These communications are part of Cinema Intelligence and you have the option to unsubscribe in case you would like to stop receiving automated e-mails or in-app messages.

To promote new features and drive engagement with Cinema Intelligence: We use your contact information and information about how you use Cinema Intelligence to send communications that may be of specific interest to you, including by email and in-app messages. These communications aim at driving engagement and maximizing what you get out of Cinema Intelligence, including information about new features, and events we think may be of interest. We also communicate with you about new product offers and promotions. You can control whether you receive these communications as described below.

Customer support: We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve Cinema Intelligence.

With your consent: We use information about you where you have given us consent to do so for a specific purpose not listed above. For example, we may publish testimonials or featured customer stories to promote Cinema Intelligence, with your permission.

3.3. Information sharing
We share information we collect about you in the ways presented below, but we are not providing or selling information about you to advertisers or other third parties.

Sharing with other Product users

When you use Cinema Intelligence, we share certain information about you with other Product users.

For collaboration: You can create content, which may contain information about you, and grant permission to others to see or edit. Some of the collaboration features of Cinema Intelligence display some or all of your profile information to other Product users when you interact with specific content. For example:

-When you chat with other Product users in your Account, we display your profile picture and name
-When you take ownership of scheduling a cinema, we will display your name under Cinema Listing
-When you create an Event under Events module, we will display your name under Organizer and Product users with permission to view the page can view this information.

Sharing with third parties

We share information with third parties that help us operate, provide, improve, integrate, customize, support and market our Product.

Cinema Intelligence Partners: We work with third parties who provide consulting, sales, and technical services to deliver and implement customer solutions around Cinema Intelligence. We may share your information with these third parties in connection with their services, such as to assist with billing and collections, to provide localized support, and to provide customization. We may also share information with these third parties where you have agreed to that sharing.

Links to Third Party Sites: Cinema Intelligence may include links that direct you to other websites or services whose privacy practices may differ from ours. If you submit information to any of those third party sites, your information is governed by their privacy policies, not this one. We encourage you to carefully read the privacy policy of any website you visit.

Vista Group Companies: We might share information we have about you with other Vista Group companies in order to operate and improve products and services and to offer other Cinema Intelligence services to you.

With your consent: We share information about you with third parties when you give us consent to do so. For example, we often display personal testimonials of satisfied customers on our public websites. With your consent, we may post your name alongside the testimonial.

3.4. Storage duration

How long we keep information we collect about you depends on the type of information, as described in further detail below. After such time, we will either delete or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.

Account information: We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate Cinema Intelligence. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Product. Where we retain information for Product improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Product, not to specifically analyze personal characteristics about you.

Information you share on Cinema Intelligence: If your agreement expires, your information and the content you have provided will remain in order to allow your team members to make full use of Cinema Intelligence. This way we ensure there is no downtime. If the account is disabled, your information is deleted.

Managed accounts: If Cinema Intelligence is made available to you through an organization, we retain your information as long as required by the administrator of your account.

Marketing information: If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our Product, such as when you last opened an email from us or ceased using your Cinema Intelligence account.

3.5. Access and control

You have certain options when it comes to your information.

You have the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format. Below, we describe the tools and processes for making these requests. You can exercise some of the choices by logging into Cinema Intelligence and using settings available within Cinema Intelligence or your account. You may need to contact your administrator to assist with your requests first.

Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person.

Access and update your information: Cinema Intelligence gives you the ability to access and update certain information about you directly from the application. By accessing User Details section, you can add or update:

-First name
-Last name
-Profile Picture
-User preferences

Deactivate your account: If you no longer wish to use Cinema Intelligence, please contact your dedicated Customer Success Manager or our Support team. Please be aware that deactivating your account does not delete your information; your information remains visible to other Product users based on your past usage of Cinema Intelligence.

Delete your information: You can remove content that contains information about you using the editing capabilities associated with that content, and you can remove certain profile information within your profile settings. Please note, however, that we may need to retain certain information for historical data tracking purposes.

Request information processing: You can request that we delete your User and attached information. When you gave us consent to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time. You can also unsubscribe from our automated e-mails and in-app messages. When you make such requests, we may need time to investigate and facilitate your request.

Unsubscribing: You may unsubscribe from receiving general communications from us by using the unsubscribe link within each email, or by contacting us to have your contact information removed from our marketing email list or database.

4. Data Storage and security
4.1. Backup and Restore
At Cinema Intelligence, we are committed to delivering a highly available and quality service. Our infrastructure team is following a set of DevOps principles that have proven successful for the past years in achieving these goals.

We have implemented a full backup Infrastructure as core philosophy, by decoupling the service required configuration from the virtual infrastructure.

Daily backups of our data sources start at around 12:00 AM CET, thus ensuring the availability of the data from the day before. Although it takes longer to finish and requires more storage, we only use full backups. This is to ensure a minimal time to restore data.

All backups are stored in two separate datacenter locations for redundancy (primary in the Nederland and secondary in Ireland). Each of these locations contain three copies of data, ensuring an availability of 99.95% / site for the backup files.

Backups of the data sources are traced via our primary monitoring interface.

We use Azure Security Center to monitor access to the backup storage accounts. The IT department has access to both locations, while the Development team has read access only to the primary location.

We also have a disaster recovery policy designed with the same infrastructure as core philosophy. We redeploy on weekly basis the latest version of Cinema Intelligence using the customer’s latest data backup. This ensures the quality of the application before it reaches production and that the deployment process is successful. Also, with this procedure, we simulate what would happen in case of a disaster and how fast we can recover.

There are multiple steps in the disaster recovery procedure, depending on the location of the issue:

1.Restore Azure infrastructure. If the Azure datacenter is affected, we can redeploy all the virtual resources within 30 minutes into another Azure datacenter.
2.Restore client database from primary backup location within 20 minutes.
3.Restore Cinema Intelligence version. Redeploy a specific version of CI within 5 minutes.
4.Restore networking. If there is an outage that requires redeploying a different, there are two scenarios covered:

a. Connection without VPN. We would require the client to unblock two IP addresses in different datacenters (primary in the Nederland and secondary in Ireland). Thus, if the primary datacenter fails, we can restore the Azure infrastructure (server, storage) and attaching the secondary IP address. This ensures connectivity with ticketing system is not affected
b. Connection with VPN. If high availability is desired in this scenario, we require creating a secondary VPN connection in a different datacenter. In case of a disaster, we would then restore the Azure infrastructure in the same network where the secondary VPN connection is.

4.2. Application Security

Cinema Intelligence application is web-based solution accessible using an internet browser.

Access to this URL can be restricted to a VPN, corporate network or other restrictions based on firewall configuration.

We deploy industry-standard security technologies to ensure only authorized users can access the application.

These procedures include:

1.Usage of encrypted communication using RSA 4096bit encryption secure certificate.
2. Microsoft Azure Firewall to restrict access to the application
-Security Token based authentication using OAuth 2.0 protocol
3. Password encryption using Transparent Data Encryption (TDE) technology.

Measures are taken to prevent unauthorized access to IT systems.

These include the following technical and organizational measures for user identification and authentication:

  1. Password procedures (incl. special characters, minimum length, forced change of password)
  2.  No access for guest users or anonymous accounts
    • Central management of system access

Access to IT systems subject to approval from HR management and IT system administrators. It is strictly restricted to our employees and governed by our internal procedure on access to customer cloud environment.

5. Cookies policy
When you visit our website(s), the following cookies may be downloaded to your device.

Strictly necessary cookies: These cookies are required for administration and operation. Without such cookies, our Product or website(s) may not work properly. These include, for example, cookies that enable you to log into secure areas. If these cookies are blocked or disabled, some of the functions will not be available to you and you may not be able to use our services. These cookies do not gather information about you that could be used for marketing purposes.

Functional cookies: These cookies are used to recognize you when you return. They enable us to personalize our content for you, to greet you and remember your preferences. For example, we use cookies to keep you logged in to your account while you change between web pages.

Performance cookies: These cookies allow us to recognize and count the number of visitors/users and to see how such visitors/users move around. This helps us to improve the way our Product and website(s) works, for example, by ensuring that users are finding what they are looking for easily.

Cookies we use

Intercom: We use third-party analytics services to help understand your usage of our services. In particular, we provide a limited amount of your information (such as sign-up date and some personal information like your email address) to Intercom, Inc. (“Intercom”) and utilize Intercom to collect data for analytics purposes when you visit our website or use our product. As a data processor acting on our behalf, Intercom analyzes your use of our website and/or product and tracks our relationship by way of cookies and similar technologies so that we can improve our service to you. Cinema Intelligence Product and website(s) may include links that direct you to other websites or services whose privacy practices may differ from ours. If you submit information to any of those third party sites, your information is governed by their privacy policies, not this one. We encourage you to carefully read the privacy policy of any website you visit.

Turning Off cookies

If you do not want us to install cookies or you don’t agree to how we use them in any way, you can change the settings on your internet browser or reject cookies.

The “Help” section of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.

However, if you use your browser settings to block all cookies (including those cookies that are strictly necessary for administration and operation) you may experience reduced functionality or not be able to access all or parts of our Product or website(s).

6. Additional details
International transfers to third parties: Some of the third parties described in this privacy policy, which provide services to us under contract, are based in other countries that may not have equivalent privacy and data protection laws to the country in which you reside. When we share information of customers in the European Economic Area, we make use of the EU-U.S. Privacy Shield Frameworks, European Commission-approved standard contractual data protection clauses, binding corporate rules for transfers to data processors, or other appropriate legal mechanisms to safeguard the transfer.

Our policy towards children

Cinema Intelligence is not directed to individuals under 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us.
